Ruling Favors Oregon LNG in Lawsuit against Port of Astoria A U.S. District Court Judge has upheld a lower court’s ruling that the Port of Astoria violated its sublease with Oregon LNG when it failed to renew a lease of state lands for the Skipanon Peninsula.
As a result of the ruling the Port will be required to renew its state lands lease for a 30-year term. Last April, Oregon LNG renewed its sublease for the disputed land for a 30-year term, but in August the Port renewed its state lease for only two years.
Oregon LNG has sued the Port for breach of contract, requesting that the 30-year lease with the state be renewed and seeking damages and legal fees. Port Commissioner Floyd Holcrom told the Daily Astorian that the Port may consider a further challenge to the ruling in the Ninth Circuit Court of Appeals. |
